Terms of Service

1. About the App

Meetings Count provides a verified attendance system for recovery meetings to support accountability for legal or treatment requirements.

 

2. Your Account

You’re responsible for your login security and the accuracy of information you provide. Do not share or impersonate another user.

 

3. Use of the App

Use the app only for lawful purposes. Do not falsify attendance, interfere with the app, or reverse engineer the software.  Your usage of the app including registering, logging in, performing check-in or check-out, confirming an attendee or clicking links sent to you is an acceptance and acknowledgement of this agreement.

 

4. Payments

Payments are securely processed by Stripe. You’re responsible for applicable fees and taxes. Transactions follow Stripe’s own terms.  Our services are billed in advance of the service period.  You may cancel at any time.  We are not obligated to store or provide access to data for any account that has been canceled or suspended.  You are entitled to a full refund for any paid service period that has not yet started, but that you have fully paid for at the time you request the refund.  If you cancel your account we reserve the right to delete your attendance log data.

 

5. Reports and Verification

Users may authorize sharing reports with third parties. Once shared, Meetings Count cannot recall or edit them.

 

6. No Guarantee of Legal Outcomes

We cannot guarantee courts or agencies will accept the app’s reports. Users must confirm approval with their authority.

 

7. Limitation of Liability

Meetings Count LLC is not liable for indirect, incidental, or consequential damages from app use. In no event will our liability exceed the amount paid by you to us in the previous 6-month period.  This amount shall be considered the maximum liquidating damages.  If you are not a subscriber (i.e., confirming attendance of other people) of the system, then our maximum liquidating damages shall be $100.

 

8. Termination

You may stop using the app anytime. We may suspend accounts violating these terms.  We may terminate the service with 60-days advance notice.

 

9. Governing Law

These terms are governed by Delaware law, with disputes resolved in state or federal courts.

 

9. Communication

We use both email and text messaging to communicate with our users including system login and sending reports.  You agree that we may send you email and text communications.  You may opt out of future communication; however, you will be unable to access your account or information.  You agree that if you give us the cellphone number of another person to confirm your attendance, that you will obtain their approval to receive text messages from us prior to giving us the cellphone number. .  You agree that if you give us the email address of another person to confirm your attendance, that you will obtain their approval to receive email messages from us prior to giving us the email address.  If you have given your cellphone number or email address to a person for entry into this system you agree to receive text and email messages from us and the terms of this agreement shall apply to you.

 

10. Proper Usage

You agree to not attempt to confirm your own attendance or falsify the attendance of another person.  You agree to allow us to access the location services of your device.  You agree to allow us to store cookies on your device to validate your login and identity.

 

11. Access to System and Location Data

Accessing the system requires internet service.  You are responsible for providing your own internet connection, data services and text messaging.  If access to the internet, location data, or the system itself is not available for any reason you are responsible for creating your own manual attendance records.  

 

14. Force Majeure

Neither party shall be held liable for failure or delay in fulfilling obligations under this agreement due to events beyond their reasonable control. These events include, but are not limited to, acts of God, natural disasters (e.g., floods, fires, earthquakes), war, terrorism, civil unrest, government actions, pandemics, or other unforeseen circumstances.  We are not responsible for maintaining backup data, reports or logs beyond the normal operation of the system.
